When commissioning a piece of artwork from me, NACHTKERN, you agree to the following terms:

• Payment: unless agreed on otherwise, I take full payment upfront, through Paypal. The prices and commission types I share are generally guidelines, and up for negotiation; if you want something different, or within a certain budget, just let me know and we can work something out. I've got a good range, and I can provide more examples if you're looking for something specific.
   
• Cancellation & Refunds: I reserve the right to cancel or decline a commission for any reason.
  
  You are entitled to a full refund if I have not yet started on the piece, or a partial refund if I have started on, but not completed the piece. I don't do refunds for a piece I consider (near-)complete, so if you want to cancel a commission and receive a refund, be sure to let me know as soon as possible!
   
• Communication: you are always welcome to ask for updates or to see WIPs. I usually complete work in one sitting, so if you would like me to save any WIPs, make alternative versions of the final piece, or share the working file with you afterwards, it's better to let me know upfront, as I may not be able to provide them retroactively. • Credit & Usage: credit me for the artwork as NACHTKERN (Neocities/Toyhou.se/Tumblr) or boblitt (Art Fight), preferably with linkback or tag. Don't remove my signature from the artwork.
  
  With the exception of commercially/for-profit (ex. in a game or monetized video), and unless otherwise agreed on, you can share, use, and edit the finished artwork however you like. My prices reflect personal use only, so if you want to use my work in something you intend to sell or earn from, please discuss that with me first. You may not alter or use my work with genAI or other machine learning models, nor use it in training one, even if the work was made for you.
   
• Edits: you can always ask for any corrections or edits to the piece, both before and after completion; I will usually do them so long as I feel they are reasonable and within my scope. Though there is no time limit, it's better to ask for changes as soon as possible, because I don't usually keep my working files for very long after completing a piece. I reserve the right to decline making an edit for any reason, but if this leads to me being unable to complete the piece, you are entitled to a partial refund.
   
• Custom Character Designs: when commissioning me for a character design, you also agree to my Design TOS.
   
• NSFW: NSFW pieces may have an upcharge or be priced differently from other work. This refers to pieces that are sexually explicit, fetish content, or otherwise mature. It includes explicit gore (whether intended sexually or not), but does not include most plain nudity or blood without gore.
   
• Restrictions: you must be 18 years or older to commission me, even if the requested piece is SFW in nature. There are some things I won't draw, such as things I consider hateful, harmful, and some types of fetish content. You are always welcome to bring it up and discuss if you're not sure.
